Character & Fitness Investigations

The Board gives Barry Law applicants who appear before them an opportunity to put troubling past conduct into context, and to explain why it would not impact their work as a Florida attorney, if the Board decides to recommend their admission.

Fear of the unknown is unpleasant, and an applicant’s attorney should be able to shed some light on the Board’s proceedings to help quell that fear. This takes representing applicants at more than a few hearings.

Elizabeth is an attorney experienced in bar admissions. She understands what evidence is necessary to meet the burden of proof, has familiarity with the members of the Board, and can guide the applicant to professionals who could help with admission, if necessary.

Each of the following situations might call an applicant’s character & fitness into question, but generally, none of them will necessarily preclude an applicant from practicing law in Florida:

  • blemishes in academic credentials
  • financial struggles and poor credit
  • law enforcement contacts, detentions, criminal charges
  • living with an addictive disease or mental illness
  • lawsuits or other claims/complaints
  • employment problems
  • poor driving history and DL suspensions

These type of situations present opportunities for a Barry Law applicant to demonstrate to the Board honesty, personal growth and show how applicant has rehabilitated and learned something from their experiences.

Candor

Sometimes applicants don’t feel compelled to be honest about information they provide, even if they are not lying per se.

But if a prospective lawyer cannot be fully truthful about themselves now, how can they be trusted to be fully truthful with their clients, colleagues and the courts in the future?

Lack of disclosure can all too easily lead to serious problems with Florida Bar admission. The risks involved with erring on the side of silence are enormous. When in doubt, disclose.
